GDPR Information Obligation

Information obligation pursuant to Article 13 GDPR

On May 25, 2018, Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as „GDPR”) came into force. In connection with this, we are informing you about the processing of your data and the principles on which it will be carried out after May 25, 2018.

Co-administration

As part of the joint administration agreement, we exercise due diligence to ensure the security of your data processing, and you can contact either administrator with any questions. We have clearly divided our tasks among ourselves by entering into a joint administration agreement:

  • Mrotex sp. z o.o and Partners jointly fulfill the information obligation
  • Mrotex sp. z o.o. is responsible for enabling you to exercise your rights – for this purpose, contact us at the contact details found above.

Data source

Data was provided during account registration on the www.www.mrotex.com/shop website and during activity on our store, while the Administrator was providing services.

Data Processing Objectives (Agreement)

We are processing your personal data because it is necessary for the performance of the contract concluded with you, including for:

  • opening and managing an account and conducting transactions;
  • execution of agreements concluded with the client, including handling complaints and returns;
  • handling customer-submitted requests (contact form);
  • providing the best customer service.

Legally justified interest

We also process your personal data for purposes based on the legitimate interest of the Data Controller, which is:

  • ensuring proper compliance with tax law provisions and accounting regulations;
  • for the purpose of establishing, pursuing, or defending against claims, which is the realization of our legitimate interest;
  • ensuring accountability (demonstrating compliance with legal obligations);
  • ensuring the security of transactions, including the prevention of criminal offenses;
  • Content matching according to your preferences, based on previously viewed page content, or primarily on products of interest;
  • monitoring your activity on our websites.

Agreement

We also process your personal data with your consent:

  • regarding the transmission of commercial and promotional information via electronic devices;
  • to the extent not covered by the legitimate interest of the Controller in saving data in cookie files, collecting data from websites and mobile applications;
  • for the purpose of organizing promotional campaigns and contests.

You may withdraw your consent to the processing of personal data by the Administrator at any time, in a manner as easy as it was given. Your data will be processed by the Administrator until consent is withdrawn.

Data scope

We need your personal data to fulfill the contract in the scope of: requirements mandated by tax regulations, as well as your first name and last name, phone number, email address, PESEL number, date of birth, and shipping address.

Data recipients

The Administrator will have access to your personal data.

Your personal data is accessible to accounting firms, legal firms, courier companies, payment processing companies, IT companies, and software providers, based on relevant data processing agreements.

Profiling

Your personal data may also be processed in an automated manner (including through profiling). Profiling involves processing data (also in an automated manner) by using it to evaluate certain information about you, in particular to analyze or predict personal preferences and interests. This does not affect your situation.

Data retention period

Personal data will be processed for the period:

  • conclusion of the agreement - for its duration and after its termination for the purposes of:
    • claims investigation related to a completed contract;
    • fulfillment of obligations arising from legal regulations, including in particular tax and accounting regulations;
    • prevention of abuse or crime;
    • statistical and archival;
  • marketing activities – for the duration of the agreement, upon separate consent to process such data – until the completion of transaction processing, or until you lodge an objection to such processing, or withdraw your consent;
  • Sales and promotional activities – e.g., contests, promotional campaigns – for the duration and settlement of such campaigns;
  • operating activities – until the statute of limitations for obligations imposed by generally applicable legal provisions expires.

User rights

  • request access to and rectification, erasure, restriction of processing, objection to processing, and data portability from the Administrator;
  • to withdraw consent at any time without affecting the lawfulness of processing based on consent before withdrawal;
  • for filing a complaint with the supervisory authority, President of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warsaw (https://www.giodo.gov.pl/pl);
  • Providing personal data is a contractual condition. Providing data is voluntary, although refusal to provide it is equivalent to the impossibility of considering the offer of services through the form.

Exercising the right to data correction, deletion, restriction of processing, rectification, as well as withdrawal of consent to receive commercial information is done by sending such a request to the Administrator at the e-mail address shop@mrotex.com or to the address indicated in point 1.
